An Analysis of the Methods of Harmonisation of International Commercial Law and Why Many Areas of Commercial Law Remain Un-Harmonised

This essay discusses, using qualitative methodology, the methods adopted by institutions to achieve harmonisation of international commercial law, and the rationale behind the un-harmonisation of many areas of commercial law.This essay reveals that institutions like UNIDROIT, HCPIL and UNCITRAL have to some extent carried out their mandates of harmonisation via legislative, explanatory, contractual and restatement of law methods. However, the extent to which this mandate can be achieved has been impeded by some factors such as the inertia nature of humanity; political, cultural and economic reasons; institutional constraint; working group constraint; national delegates constraint; needs of humanity; and bar and bench recognition in various countries
