AS TEORIAS DA CULPABILIDADE E SUAS PERSPECTIVAS EVOLUTIVAS
A palavra Culpabilidade refere-se ao juízo de censura, de reprovação que se faz sobre a conduta típica e ilícita praticada pelo sujeito ativo. Reprovável ou censurável é a conduta realizada pelo agente que, nas condições em que se encontrava, podia agir de modo diverso. Assim diz Miguel Reale Júnior y Greco: 'Reprova-se o agente por ter optado de tal modo que, sendo-lhe possível atuar de conformidade com o direito, haja preferido agir contrariamente ao exigido pela lei. [...] Culpabilidade é um juízo sobre a formação da vontade do agente'1 . Nosso estudo se concentrará na análise da culpabilidade como elemento do delito, analisando as teorias que tentaram defini-la, e, em seguida, como princípio penal de carga subjetiva, que faz necessário a presença de profissionais do comportamento humano para a sua definição.
