Ausländische Kapitalbeteiligungen in Jugoslawien (joint ventures) Nach einem kurzen Überblick über die gesetzlichen Vorschriften für ausländische Kapitalbeteiligungen in Jugoslawien (den sogenannten joint ventures) werden die einzelnen kontroversen Probleme, die sich aus der Verschiedenheit der rechtlichen und wirtschaftlichen Organisationsformen einer sozialistischen Gesellschaft einerseits und den westlichen Marktwirtschaften andererseits ergeben, theoretisch behandelt und ihre praktischen Lösungen gezeigt. Das theoretische Hauptproblem stellt die Eigentumsfrage und die damit zusammenhängende rechtliche Natur des ausländischen Anteils im jugoslawischen joint venture dar. Ebenso wichtig für den ausländischen Investor sind aber auch die Fragen der Kontrollen und der Geschäftsführung im gemeinsamen Unternehmen, ferner auch Haftung und Besteuerung des Ausländers. Der jugoslawische Gesetzgeber hat, ohne von den in der Verfassung verankerten Prinzipien abzugehen, dem ausländischen Partner praktisch fast dieselben Rechte zuerkannt, die er gehabt hätte, wenn er an seiner Beteiligung ein privates Miteigentum an dem Unternehmen erhalten hätte. Mit Rücksicht darauf, daß das Gesetz die Regelung vieler Einzelfragen den Parteien überlassen hat, haben diese oft in ingeniöser Weise Lösungen zum beiderseitigen Ausgleich gefunden. Als Beweis dafür mag dienen, daß die bestehenden gemeinsamen Unternehmen wirtschaftlich gut gedeihen und bisher keine Unstimmigkeiten zu verzeichnen waren. Der makroökonomische Erfolg dagegen war etwas mäßiger. Obwohl die Zahl der registrierten Verträge (über 120) als gar nicht unbedeutend zu bezeichnen wäre, zögern die ausländischen Interessenten. Trotzdem sollte man das System beibehalten und durch Klarstellung der noch strittigen Punkte von amtlicher Seite vervollkommnen. Das wäre auch im Sinne der OECD. Denn im großen und ganzen hat der jugoslawische Versuch mit den joint ventures gezeigt, daß eine ersprießliche wirtschaftliche Zusammenarbeit zwischen West und Ost möglich ist, sofern man sich auf rein wirtschaftliche Ziele beschränkt.
