Die Unabhängigkeit von Kartellbehörden
Zusammenfassung In den letzten Jahren haben in vielen Industrie-, Entwicklungs- und Transformationsländern die nationalen Wettbewerbsbehörden mehr Unabhängigkeit erlangt. Man kann wohl davon ausgehen, daß politisch unabhängige Kartellbehörden die Wettbewerbsgesetze stärker wettbewerbsorientiert anwenden als Regierungen. Der Beitrag diskutiert verschiedene Unabhängigkeitsaspekte und zeigt auf, wie einige Unabhängigkeitsmerkmale in die Praxis umgesetzt wurden. Der relevante Unabhängigkeitsgrad wird nicht nur durch die institutionelle Stellung der Behörde bestimmt, sondern auch durch zahlreiche andere Faktoren beeinflußt. Hierzu zählen unter anderem der Anwendungsbereich des Wettbewerbsgesetzes, die Zahl der Ziele, die die Behörde zu beachten hat, und die Rolle sektoraler Behörden. Die Unabhängigkeit von Wettbewerbsbehörden könnte die internationale Kooperation in der Wettbewerbspolitik erleichtern. Eine dezentrale Anwendung des EG-Wettbewerbsrechts könnte ebenfalls einfacher erreicht werden, wenn die nationalen Behörden der Mitgliedstaaten unabhängig wären.
