This work deals with the various facets of EU and Member States’ actions which influence the functioning of the internal market in the field of automotive industry and services. In a first part (paragraph 2), it analyzes the internal market structure, with a special focus on those of its mechanisms who play a significant role in the field of automotive industry and services. A specific attention is therefore devoted to the free movement of goods and the customs union. Moreover, the interplay between the automotive market and the freedom of circulation of persons and services is taken into account from a general point of view. Thereafter, the author deals with some harmonized areas, directly relevant for the free movement of the goods in the automotive industry, such as vehicle type approval (paragraph 3), and technical inspections (paragraph 4). Case law is also considered, especially in fields where the harmonization is only limited, or is still awaited, and discriminatory technical norms, as well as unjustified controls, still exist (paragraphs 5, 6). In this framework, the analysis necessarily draws a line between measures applying to the importation, and those applying to the exportation of motor vehicles (paragraph 7). The study of the case law reveals moreover some examples of national measures dealing with import and marketing of vehicles that can hinder, at least potentially, other internal market freedoms, namely the freedom to provide services, the freedom of establishment and the free circulation of workers (paragraph 8). Further, at paragraph 9 the author deals with the effect of the TVA partial harmonization on the automotive industry and services, by analyzing some interesting examples taken by the case law. Non harmonized fiscal policies (registration taxes, eco-taxes), and the limits to their application arising from the proportionality principle, are taken into account in the following paragraph 10. The influence of intellectual property rights on the automotive industry and services is made the object of paragraph 11, while paragraph 12 stresses the importance of many other sets of EU laws and policies – such as competition law, trans-European networks, research policy, and especially the EU environmental policy. At paragraph 13, finally, the article points out the importance of setting up environmentally friendly technical standards at the international level, and particularly in the framework of the UN ECE. At the same time, the need to ensure an extended democratic accountability of such international fora is highlighted. *** Questo lavoro affronta molteplici aspetti dell’azione degli Stati e delle istituzioni dell’Unione, che a vario titolo incidono sulla realizzazione in Europa di uno spazio in cui circolino liberamente merci, persone, servizi e capitali legati all’industria dell’auto, sia dal punto di vista della produzione e commercializzazione, sia dal punto di vista dell’utilizzazione dell’auto come bene strumentale. Il lavoro procede anzitutto all’individuazione del quadro complessivo di immediato riferimento, quello cioè del mercato interno, mettendone in evidenza i meccanismi fondamentali, ed in particolare quelli chiamati a giocare un ruolo nella realizzazione del mercato interno dell’auto (paragrafo 2). Viene dunque presa in considerazione la libera circolazione delle merci, con le sue articolazioni nell’ambito dell’unione doganale e del divieto di misure di restrizione quantitative e di effetto equivalente. Inoltre, si prendono in considerazione le ricadute sul settore automobilistico delle libertà di circolazione delle persone e dei servizi in relazione all’ammissibilità di misure indistintamente applicabili relative al commercio delle automobili ed alla loro utilizzazione. Si verifica in particolare come interventi statali in settori solo parzialmente armonizzati, quale la tassazione indiretta, possano dar luogo ad un’indebita compressione della libertà di prestazione dei servizi, o della libertà di circolazione dei lavoratori, o ancora della libertà di stabilimento, tramite un ingiustificato aggravamento delle condizioni di utilizzazione del bene strumentale automobile. Si evidenza ulteriormente come effetti negativi sul settore automobilistico possano derivare da misure nazionali che incidono negativamente su attività di servizi che contribuiscono alla circolazione della merce automobile, com’è il caso del leasing di autovetture. Successivamente, si affina l’analisi con riferimento specifico ad alcuni ambiti, oggetto di interventi normativi di armonizzazione rilevanti per il settore automobilistico. Si prende pertanto in considerazione l’armonizzazione delle norme in materia di omologazione (paragrafo 3), sottolineando l’importanza che in questo settore riveste la cooperazione nell’ambito della Commissione Economica per l’Europa delle Nazioni Unite. Ancora, è analizzata l’armonizzazione parziale dei requisiti e delle procedure di controllo tecnico per l’immatricolazione e la circolazione dei singoli autoveicoli, e la giurisprudenza rilevante in tale settore (paragrafo 4). L’analisi della giurisprudenza compiuta al successivo paragrafo 5 mette poi in luce l’esistenza di norme tecniche nazionali discriminatorie e di misure di controllo distintamente applicabili non giustificate. Ancora, emergono misure in materia di norme e controlli tecnici che, pur essendo indistintamente applicabili, risultano tuttavia inidonee a raggiungere gli scopi per le quali sono formalmente adottate (paragrafo 6). Il paragrafo 7 è poi dedicato all’analisi delle misure nazionali all’esportazione nel settore automobilistico, dove il margine lasciato all’azione degli Stati è molto più ampio: quelle misure non saranno oggetto di alcuno scrutinio da parte della Corte di Giustizia – neppure in relazione alla loro proporzionalità, a meno che non possano essere qualificate come misure equivalenti a restrizioni quantitative all’esportazione, nei termini restrittivi che emergono dal consolidato approccio giurisprudenziale. Al paragrafo 8 si analizzano ulteriormente casi in cui misure relative alle automobili, compresa la loro importazione e messa in circolazione, entrano in conflitto, almeno potenziale, con altre libertà del mercato interno. In particolare, si mette in luce come le misure relative ai controlli di omologazione e ai controlli tecnici possano dar luogo a restrizioni alla libera prestazione dei servizi, e si critica la giurisprudenza della Corte per l’azzardato riferimento in essa contenuto alle prerogative dei pubblici poteri, in contrasto con l’approccio restrittivo adottato in generale dalla Corte alla definizione di tali prerogative. Ancora, si prendono in considerazione le misure nazionali relative all’obbligo di nuova immatricolazione o di sostituzione della patente di guida, in caso di trasferimento della residenza da uno Stato membro ad altro, sottolineando come esse incidano sull’esercizio della libertà di stabilimento e della libertà di circolazione dei lavoratori, e come le sanzioni legate alla loro violazione debbano pertanto rispettare i limiti imposti in linea generale all’esercizio del potere sanzionatorio in relazione ad elementi formali non costitutivi del diritto. Al paragrafo 9 si considerano poi le intersezioni tra le scelte di politica fiscale degli Stati membri, la parziale armonizzazione dell’IVA operata a livello dell’Unione e il mercato interno nel settore dell’auto. Si mettono dunque in evidenza gli strumenti adottati per evitare perturbazioni dei flussi commerciali. Si considerano inoltre quei casi della giurisprudenza più direttamente connessi con il mercato interno dell’auto e con l’incidenza delle scelte impositive in materia automobilistica. Si tratta per l’essenziale di questioni relative alle esenzioni previste per le fattispecie di importazione, o di questioni relative a rimborsi, al fine di evitare una doppia imposizione e con essa un ostacolo alla libera circolazione delle persone, o una perturbazione dei mercati relativi alla commercializzazione (messa in vendita, locazione o leasing) dell’automobile. Al paragrafo 10 si considerano le interazioni tra le libertà del mercato interno e le scelte nazionali di politica fiscale in settori non armonizzati, su cui la Corte è stata spesso chiamata ad intervenire
