Erfahrungen und Herausforderungen der Telekommunikationsregulierung in Deutschland

The liberalization and regulation of telecommunications markets in Germany is called, despite some adversity as a great success. Consumers enjoy, in contrast to the days of state owned monopoly, affordable and innovative products. In the center of the regulation was for almost one and a half decades the non-discriminatory access to the copper-based infrastructure of the incumbent. Due to technical progress, the focus of regulation will continue to move to other areas, such as, for example, issues of access to new fiber optic networks, network neutrality on the Internet and Voice over IP. To find appropriate solutions for these difficult regulatory questions, partly new regulatory approaches have to be developed. This paper briefly presents the historical evolution of telecommunications regulation in Germany and the status quo of regulation. In the sections following the presentation of the status quo, new challenges for telecommunications regulation are outlined and proposals to find solutions for these challenges are described if available. Die Liberalisierung und Regulierung der Telekommunikationsmärkte in Deutschland ist trotz einiger Widrigkeiten als großer Erfolg zu bezeichnen. Verbrauchern stehen, im Gegensatz zu den Zeiten des staatlichen Monopols, preisgünstige und innovative Produkte zur Verfügung. Im Zentrum der Regulierung stand für fast eineinhalb Jahrzehnte der diskriminierungsfreie Zugang zur kupferbasierten Infrastruktur des etablierten Anbieters. Durch technischen Fortschritt wird sich der Fokus der Regulierung künftig auf andere Bereiche verschieben, wie beispielsweise Fragen des Zugangs zu neuen Glasfasernetzen, Netzneutralität im Internet und Voice over IP. Zur Lösung dieser Fragen müssen teilweise neue regulatorische Ansätze entwickelt werden. Der vorliegende Beitrag stellt die bisherige Entwicklung der Telekommunikationsregulierung in Deutschland sowie den Status quo dar. In den darauf folgenden Abschnitten werden neue Herausforderungen für die Telekommunikationsregulierung skizziert und soweit vorhanden erste Lösungsvorschläge dargestellt.
