Estándares de prueba del daño en las acciones de responsabilidad civil contra cárteles bajo derecho Español y de la UE (Standards of Proof of Damage in Cartel Damages Actions under Spanish and EU Law)
Spanish Abstract: Los últimos pronunciamientos judiciales en España referidos a acciones por daños frente a cárteles han evidenciado una disparidad de enfoques en relación con las distintas facetas del daño, a pesar de los recientes avances por parte de varios órganos judiciales de segunda instancia. Los dos precedentes del Tribunal Supremo en el Cártel del Azúcar han sentado las bases de este tipo de acciones, pero no responden a todas las cuestiones que ahora se suscitan. La Directiva de Daños tampoco ofrece respuestas claras más allá de consolidar el “acquis” del Derecho de la Unión y de recordar en su artículo 17(1) que los Estados Miembros han de velar por que ni las reglas de la carga de la prueba ni tampoco los estándares de prueba vulneren el principio de efectividad. El objetivo de este trabajo consiste en exponer las dificultades jurídicas y fácticas de la prueba de la existencia del daño y su cuantificación en el caso de acciones de responsabilidad civil contra cárteles en España, así como en identificar los principios y criterios que faciliten su interpretación en la práctica
