Grenzüberschreitende Bankgeschäfte im Zielfeld politischer Intervention
Abstract Der grenzüberschreitende Geldverkehr sieht sich zunehmend mit politisch motivierten Eingriffen konfrontiert. Den Gerichten ist es bislang nicht gelungen, sich auf ein konsistentes Gefüge von Regeln zur Lösung der – gewiß nicht einfachen – Konflikte zu einigen. Legislatorische Maßnahmen werden von partikularen Interessen bestimmt. Die Abhandlung verfolgt das Ziel, verläßliche Grundsätze zu erarbeiten, die die Funktionsfähigkeit der internationalen Finanzmärkte fördern und zugleich die legitimen Eingriffs- und Regulierungsbedürfnisse der staatlichen Ordnungsmächte respektieren.
