Il diritto: dittatura della legge o riflessione prudente di libertà?
Reflexiones sobre algunas dimensiones y determinados paradigmas del pensamiento de Michel Villey. La atención principal se centra en el Derecho natural frente al positivismo. Villey se mostró contrario al idealismo alemán y al positivismo legalista estatolátrico, proponiendo un retorno a Aristóteles, el Derecho romano y Santo Tomás de Aquino. Villey manifestó su desacuerdo con Kant y, en particular, con su obra El conflicto de las Facultades, donde asigna una función menor a las Facultades de Derecho y a los juristas sobre lo que es el Derecho. Precisa, igualmente, la presente colaboración cuáles son las razones de que muchos juristas, que defienden el estado de Derecho, manifiesten a la vez una alergia alarmante hacia la Filosofía del Derecho. Se propone una reflexión prudente de la justicia.
