La antropología jurídica tiene una naturaleza multidisciplinar, abarcando tanto la dogmática jurídica como la ciencia del Derecho. Para un estudio adecuado del Derecho de familia es necesario el análisis de ámbitos tan diversos como la antropología de la familia, la sociología de la familia, la psicología de la familia o una filosofía de la familia. Scillitani hace referencia también a la φρόνησις, que en la actualidad podríamos identificar como sabiduría práctica o, al menos, como sabiduría de juicio. Esta φρόνησις está formada por reglas (de juicio) verdaderas. También se refiere a la reciprocidad sin obligaciones y las obligaciones sin reciprocidad. A juicio de Karl Jaspers, el amor es el fundamento de todas y cada una de las distintas relaciones fiduciarias. Pero habría que resaltar que la confianza no es recíproca, sino que procede de la unilateral desinteresada del amor, que por definición es libre. Por ello, concluye Lorenzo Scillitani, la obligación sin reciprocidad se calificaría como un deber de amor. Scillitani denomina a la antropología jurídica hija de la Historia del Derecho. Pero la antropología jurídica moderna sería impensable sin Montesquieu, Mauss o Claude Lévi-Strauss. En otro ámbito, también se refiere a los derechos y los deberes del hombre y de la mujer que, a partir de 1948, adquieren un carácter universal, acentuado por el proceso de globalización. Pero uno de los momentos más trascendentales ha sido la emancipación de la mujer, y su equiparación al hombre. Plantea asimismo la cuestión de la licitud o ilicitud de fabricar embriones humanos para la investigación (Bioética). La relación entre el Derecho y el lenguaje no es baladí. Considera que el lenguaje procesal representa no sólo un nivel lingüístico simbólico, sino también metasimbólico. Pero para ser calificado como jurídico, debe poseer determinadas características. Una cuestión distinta es el diálogo (διάνοια) en el lenguaje, que permitiría la resolución de los problemas actuales. El lenguaje del diálogo se presenta como el primer lenguaje de la verdad, en la medida en que la verdad comienza con la dualidad. Otro aspecto que estudia es la Convención internacional sobre los derechos de la infancia de 1989 y la protección jurídica del niño. Destaca Scillitani el pensamiento de Lévi-Strauss que identifica en el pensamiento infantil una especie de sustrato universal. Cuestión distinta a la que también se refiere es la del incesto, que plantea desde un punto de vista antropológico-jurídico y antropológico-político. Para Pascal, sólo el Derecho establecido (en virtud de la fuerza) y no un Derecho verdadero, es el único capaz de darnos a conocer la verdad y la justicia. Sin embargo, Leopardi consideraba que la idea del infinito correspondería a una idealidad nihilista, no muy alejada del concepto adoptado por Pascal, y que supondría una sustracción de las competencias a la individualidad: el infinito, de hecho, no admite individualidad. Leopardi asimila definitivamente el infinito a la nada. Aunque Leopardi niega la existencia del infinito, no censura la infinidad del deseo. Pero también estudia el pensamiento de Kant y Hegel en su concepto de infinito y sobre el deber ser. Kant consideraba al infinito como absolutamente grande, y veía al infinito como totalidad. La noción kantiana del infinito se presentaba como un ideal de la razón. Existe un enfrentamiento dialéctico entre Emmanuel Lévinas y Karl Jaspers sobre la problemática de los Derechos del hombre. El individualismo ético de Lévinas prevalece sobre el universalismo de los Derechos del hombre, procedente de la ontología del sujeto. Por el contrario, Jaspers entiende que los Derechos del hombre sólo serían viables en los Estados liberales de Derecho. Lévi-Strauss analiza algunas temáticas fundamentales de nuestro tiempo como los problemas bioéticos y jurídicos. Este autor defiende una especie de núcleo racional, basado en la razón profunda de la autoafirmación de la identidad, centrada de manera fundamental en el deseo y presente en toda cultura. A modo de colofón, Scillitani termina con una reflexión sobre el pensamiento filosófico-jurídico de Sergio Cotta, conocido filósofo del Derecho italiano, profundamente conservador.
