Neues zur Rechtsform deutscher Wertpapierbörsen
Abstract Seit 100 Jahren wird über die Rechtsform der deutschen Wertpapierbörsen diskutiert. Von der Rechtsperson des privaten Rechts bis zur eindeutig öffentlich-rechtlichen Organisation reicht das Spektrum der Meinungen. Der Gesetzgeber hat sich an dieser Meinungsbildung nicht beteiligt - nicht vor 100 Jahren und nicht 1994, als er mit dem Zweiten Finanzmarktförderungsgesetz das deutsche Börsenrecht neu schrieb. Aber der Gesetzgeber des Jahres 1994 schuf einige, wohl bedeutsame neue Rechtstatsachen, die der Rechtsformdebatte neuen Stoff geben, und zwar in Richtung auf die privatrechtliche Zuordnung der Wertpapierbörsen. - Der nachfolgende Artikel versteht sich als Auftakt zu einer erneuten Diskussion auf der Grundlage neuer Rechtsfakten.
