Spain Approaches Anglo-American Fair Use Doctrine : Do We Need to Reform the European System of Copyright Limitations and Exceptions?

Interpretation of copyright limitations and exceptions is restrictive under EU law system. Likewise is in Spain. Nevertheless, several Member States decisions concerning online infringements have been ruled sheltering the use of a copyrighted work - without owner's authorization - by limitations other than those referred by statute. Hence, a flexible interpretation of limitations has been done in detriment of present essence of European copyright legal system
