무역과 노동의 연계에 관한 글로벌 규범 현황과 시사점 (The Linkage between International Trade and Labour Standards : Current Status and Implications)
(Korean Abstract) 국제 무역협정에서 ‘무역’은 단순히 상품이 국경을 넘어 이동하는 경우를 넘어 국가간 공통된 경제 거버넌스의 문제로 확대되어왔다. 그중 국제무역에서의 노동기준은 오랫동안 논란이 되어온 사안이며 무역-노동기준의 연계 문제가 향후 중요한 통상이슈로 부상할 것으로 보인다. 국제노동기구(ILO) 등 국제적으로 인정된 노동기준이 FTA 등 양자간 무역협정에 반영되는 경우가 전 세계적으로 확산되는 추세이며, 국제 무역협정에 포함되는 노동기준의 범위와 수준, 그 집행가능성은 지속적으로 확대·개선되어왔다. 최근에는 FTA 분쟁해결제도를 통해 무역협정 내 노동의무의 불이행 여부가 사법 검토의 대상이 되기도 하였다. 본 연구에서는 크게 세 가지 측면에서 무역과 노동의 연계 현상을 검토한다. 첫째, FTA 등 전통적인 양자·복수국 간 무역협정을 통한 무역과 노동의 연계현상이 확인된다(제2장). 둘째, 무역과 노동의 연계에 관한 가장 보편적인 접근법이 FTA 등 전통적인 무역협정을 통해 교역상대국의 노동기준을 개선하는 방식이라면, 2022년 5월 출범한 IPEF 협상에서와 같이 기존 FTA 모델과는 차별화된 새로운 무역·노동연계 모델을 국제적으로 도입하기 위한 노력이 최근 확인된다(제3장). 셋째, 국제공법 차원에서 무역과 노동의 연계뿐 아니라 국내법을 통한 무역과 노동의 연계도 본격화되고 있다(제4장). 마지막으로, 본 연구의 제5장(결론 및 시사점)에서는 (ⅰ) 노동·환경 등 신통상이슈의 양자·복수국 간 통상협정을 통한 사법분쟁화 위험성 (ⅱ) FTA 노동기준 및 관련 절차규칙에 대한 명확성과 구체성 개선 필요성 (ⅲ) 해외진출 대미 수출기업에 대한 FTA 노동기준의 규제장벽화 우려 (ⅳ) IPEF 노동기준에 대한 분쟁해결·집행 메커니즘 도입 시 유의사항 (ⅴ) 강제노동 결부 상품 규제의 국내입법 시 통상법적 합치성 고려사항 (ⅵ) 주요 교역국의 노동·공급망 연계 규제에 대한 대응방안 모색 (ⅶ) 국제무역 내 노동 관련 공급망 충격에 대한 기업 지원방안 등 일곱 가지 측면에서 본 연구의 정책 시사점을 도출한다.(English Abstract) Through the evolution of international trade agreements, the conceptualboundaries of ‘trade’ have expanded beyond the simple movement of goods across national borders to a matter of common economic governance among countries. In particular labor standards have long been a controversial issue in international trade. The linkage between trade and labor standards is expected to emerge as an important trade issue in the future. Internationally recognized labor standards such as those adopted by the International Labor Organization (ILO) have been incorporated into FTAs, and the level of protection of labour rights has been enhanced significantly with respect to both substantive and procedural FTA provisions. Further, there have been a couple of cases where a Party’s failure of FTA labour obligations was referred to judicial review under FTA dispute settlement procedures. This study examines the trade-labour linkage in three main aspects. Firstly, the most traditional approach of linking trade and labour standard has been to improve labour standards in trading partners through bilateral and plurilateral trade agreements including FTAs. Secondly, more recently a series of attempts have been made to introduce a new trade-labour linkage model that can be distinguished from the previous FTA labour standards, as witnessed in the ongoing IPEF negotiations. Thirdly, in addition to the trade-labour linkages at the international level, the linkage at domestic level appears to be in full swing. Lastly, it is necessary to be take caution in introducing laws and systems for regulatory measures that link labour standards and supply chains, such as measures to prohibit imports made by forced labour. To prepare for labour standards and supply chain-linked regulatory measures and minimize the adverse impacts, this study advises that the Korean government consider establishment of a single response system that can jointly respond at the national level to such regulations
