Antigua and Barbuda, the International Trust Act 2007 : notes on asset protection

The purpose of this article is to give an overview of the latest legislation introduced by Antigua and Barbuda in relation to international trusts, focusing on asset protection issues. The author provides a brief introduction on asset protection, taking into consideration the peculiarities of offshore trusts. The narration then shifts to the most important features of the previous international trust legislation of Antigua and Barbuda, the International Trust Act 2004, hence leading towards discussing the main features of the subsequent piece of legislation, the International Trusts Act 2007. The amended legislation contains many provisions for achieving asset protection efficiently, granting an international trust the utmost independence and defence from external events that may interfere with its administration and properties
