L’Applicazione a 'Rete' Del Diritto Comunitario Della Concorrenza (Network Model in EU Antitrust Enforcement - An Essay on Cooperation Based Implementation of EU Law)
Il lavoro intende affrontare il tema delle modalità con cui il diritto dell’Unione europea è applicato all’interno degli Stati membri, concentrandosi, in particolare, sulle dinamiche applicative che caratterizzano il diritto della concorrenza ed altri particolari settori di regolazione del mercato. In un periodo storico caratterizzato da uno stallo nel processo di integrazione e dall’accantonamento del dibattito costituzionale in seno alle istituzioni dell’Unione europea, le forme di integrazione amministrativa tra Stati membri e tra questi e le istituzioni comunitarie procedono senza sosta. Sul fronte delle modalità applicative del diritto derivato dalle fonti europee, assumono rilevanza l’istituzione, lo sviluppo ed il perfezionamento di modelli procedimentali che si fondano su una stretta collaborazione tra autorità nazionali e Commissione, aventi come obiettivo principale l’efficace applicazione della disciplina comunitaria in un contesto orientato verso un marcato decentramento amministrativo, teso a soddisfare le esigenze del principio di sussidiarietà. In tale ambito, le forme di cooperazione che si sviluppano permettono una forte integrazione tra piani nazionali e comunitari, i quali si intersecano e si contaminao reciprocamente. La produzione giuridica che ne deriva, sia normativa che decisionale, recepisce il portato di tale dialogo e si arricchisce nel contenuto. Le stesse autorità nazionali elette responsabili dell’applicazione del diritto comunitario vedono ne subiscono le conseguenze, venendo a partecipare di una dimensione europea che ne muta l’intrinseca natura. Lo stesso Trattato modificativo firmato a Lisbona nel dicembre 2007 prende coscienza di tale sistema di rapporti e riconosce all’Unione europea una specifica competenza, di tipo complementare, al fine di “sostenere, coordinare o completare”, l’azione degli Stati mebri nell’ambito della “cooperazione amministrativa” (art. 6, lett. g) del Trattato sul funzionamento dell’Unione europea). Dopo aver analizzato le forme peculiari di organizzazione e funzionamento della “Rete europea di concorrenza” (cd. European Competition Network, “ECN”, in seguito, la “Rete”) e le modalità di cooperazione che tale sistema applicativo pone in essere tra le singole autorità garanti nazionali e tra queste e la Commissione, l'elaborato procede ad esaminare le altre esperienze applicative che, analogamente a quella in oggetto, si sono avvalse di una cooperazione strutturata ai fini di un’efficace ed uniforme applicazione di un delineato corpus di norme comunitarie. Si tratta, in particolare, della politica in materia di energia e telecomunicazioni, della gestione della politica monetaria affidata al Sistema Europeo delle Banche Centrali, nonché delle normative a tutela dei diritti del consumatore. The work deals with how EU law is implemented within Member States, particularly referring to the enforcement model of EU competition law and of other sector-specific regulation (i.e. energy, telecommunications). Particular significance is nowadays given to form of cooperation between independent agencies within Member States and EU institutions, aiming at ensuring a uniform and effective enforcement. Specific procedures provides for exchange of information and opinion, impinging from soft-power to binding effect. Rules governing the European Competition Network are reviewed in depth, together with structured cooperation existing in energy (ERGEG) and telecommunication sector (BEREC)
