Aspectos laborales de la integración económica: Mercosur y Chile
Este trabajo analiza los aspectos laborales de los acuerdos de integración; en particular, se compara la legislación laboral de los países del MERCOSUR, incluyendo a Chile ya que partir de 1996, este país se ha asociado a través de un acuerdo de libre comercio con el MERCOSUR. El trabajo discute a nivel conceptual la interacción entre integración económica y mercado laboral, principalmente en relación a las exigencias de armonización de estándares y normas laborales, analizando específicamente el caso de la Unión europea, ya que también se trata de la conformación de un Mercado Común que ha debido enfrentar la dimensión social del proceso de integración. Se concluye que hay cierto consenso acerca de la necesidad de al menos aproximar las legislaciones y estándares laborales nacionales en el caso de la creación de un mercado común con libre movilidad de trabajadores. No obstante, la experiencia europea muestra que éste es un proceso complejo, donde el grado de heterogeneidad de los países miembros de acuerdo y su situación socioeconómica juegan un rol central. El trabajo también describe los avances logrados en el ámbito de las políticas y estándares sociales en las negociaciones dentro del MERCOSUR y compara la legislación laboral de los países miembros del MERCOSUR y Chile. Este análisis muestra que existen significativas diferencias entre los países y que algunas de las diferencias más marcadas se dan en áreas donde es difícil armonizar políticas, como es el caso de la negociación colectiva y la organización sindical.
