E-arbitration and arbitration are interrelated concepts, but electronic arbitration aligns with the trends of deformalized arbitration. Despite the formal legality, the trend is breaking the existing legal framework for electronic arbitration, and allows a neglect of some binding arbitration stages. Whereas there has been a tendency towards formalization of electronic mediation, electronic arbitration ceases to be a form of proper arbitration without the necessary electronic formalization. The use of electronic means of communication in the process of arbitration is a serious problem that could undermine confidence in arbitration. If within the framework of electronic arbitration, electronic communication is implied, then within the limits of traditional arbitration, arbitrators may hold discussions for adjudication using various electronic means. Many of these, such as social networking, online chats, and forums are otherwise unsecured. In arbitration proceedings, confidentiality is implied, and the use of such means of communication is unacceptable. This article considers the problem of the ’privatization of justice’ when the arbitration is an indispensable tool for dispute resolution. This problem is common in e-commerce systems.
