Das Nebeneinander aufsichts- und zivilrechtlicher Beratungsvorgaben im Anlegerschutz – Handlungsbedarf für den Gesetzgeber?
Zusammenfassung Die Anlageberatung durch Kreditinstitute hat im deutschen Gesetzesrecht keinen zivilrechtlichen, sondern ausschließlich einen aufsichtsrechtlichen Niederschlag gefunden. Das Fallmaterial, das die Gerichte beschäftigt, ist aber vornehmlich zivilrechtlicher Natur. Diese Diskrepanz zwischen Fallreichtum im ungeregelten und geringer gerichtspraktischer Relevanz im geregelten Bereich wird im Schrifttum dadurch überbrückt, dass dem aufsichtsrechtlichen Regelungsfundus – mit unterschiedlichen dogmatischen Vorzeichen – auch eine Prägewirkung für die zivilrechtlichen Parteibeziehungen beigemessen wird. Der XI. Zivilsenat des BGH hat es dagegen in einer neueren Entscheidung vom 17. 9. 2013 abgelehnt, für die Lösung derartiger Fälle den aufsichtsrechtlichen Normenbestand als bindend anzuerkennen oder ihn auch nur im Rahmen einer unverbindlicheren „Ausstrahlungswirkung“ in die Rechtsanwendung einfließen zu lassen. Der folgende Beitrag zeigt die Folgewirkungen des Urteils auf und geht dabei insbesondere der Frage nach, ob es nunmehr dem Gesetzgeber obliegt, diese Abschottung des Zivilrechts gegenüber dem aufsichtsrechtlichen Normenbestand zu korrigieren.
