Der Fall C&A - das Ende des §7 UWG?
Nachdem das Düsseldorfer Landgericht dem Textilkaufhaus C&A eine Rabattaktion vom verboten hatte, ist das Wettbewerbsrecht in jüngster Zeit wieder verstärkt in die Diskussion geraten. Verwirrung entstand vor allem deshalb, weil das Rabattgesetz bereits im letzten Jahr abgeschafft wurde. Das Landgericht beruft sich bei seiner Entscheidung jedoch auf das Gesetz gegen unlauteren Wettbewerb (UWG). Besteht auch hier Reformbedarf?
