Die kommunalen Finanzausgleichssysteme in der Bundesrepublik Deutschland: Die Ermittlung der Finanzkraft
Ebenso wie von der Bestimmung des Finanzbedarfs gehen auch von der Ermittlung der Finanzkraft vielfältige (Verteilungs-)Wirkungen aus. Als Komponenten der Finanzkraft der Gemeinden sind deren Anteile am Einkommen- und Umsatzsteueraufkommen, die Realsteuern, eine Konzessionsabgabe sowie ggf. eine Grunderwerbsteuerbeteiligung und die Spielbankabgabe einzubeziehen. Bei den Landkreisen sollten die Kreisumlage sowie die Schlüsselzuweisungen der kreisangehörigen Gemeinden berücksichtigt werden. Während die kommunalen Finanzausgleichssysteme der Länder diese Forderung noch weitgehend erfüllen, kann die mitunter unvollständige Anrechnung der einzelnen Bestandteile nicht befriedigen. Im Sinne einer Gleichgewichtung aller Einnahmekategorien sollten alle Finanzkraftelemente in voller Höhe einfließen. Eine Besonderheit ergibt sich bei den Einnahmen mit Gestaltungsmöglichkeit, die sich den Kommunen vor allem bei den Realsteuern und der Kreisumlage eröffnet. Hier sollten normierte Sätze zur Anwendung kommen, die dem gewogenen Landesdurchschnitt der aus der jeweiligen Teilschlüsselmasse zu bedienenden Kommunen entsprechen. Mangels verlässlicher Kriterien ist darüber hinaus auf eine Differenzierung zu verzichten.
