Die Regelungen zur Gesellschafter-Fremdfinanzierung im internationalen Vergleich
Die Gesellschafter-Fremdfinanzierung wird sowohl in Deutschland also auch europaweit sowie international zunehmend restriktiv geregelt mit der Folge, dass die steuerlichen Regelungen zur Gesellschafter-Fremdfinanzierung (Thin Capitalization Rules) die Finanzierungsentscheidung multinationaler Konzerne in immer stärkerem Maße beeinflussen. Dabei belegt die internationale Diskussion zu den Regelungen zur Gesellschafter-Fremdfinanzierung (Thin Capitalization Rules), dass weltweit Regelungsbedarf gesehen wird. Steigenden Einfluss auf das Steuerrecht der Mitgliedstaaten gewinnt dabei insbesondere die Rechtsprechung des EuGH. So war nicht zuletzt die Rechtsprechung in der Rechtssache Lankhorst-Hohorst, deren Befassungsgegenstand auf die unterschiedliche Behandlung einer Tochtergesellschaft je nach Sitz der Muttergesellschaft abzielt, entscheidend für die Neukonzeption der Regelungen in Deutschland und verschiedenen anderen Mitgliedstaaten. Diese Regelungen stoßen jedoch weiterhin sowohl in Deutschland als auch international auf scharfe Kritik. Neben europarechtlichen Grundsätzen setzt die Kritik an allgemeinen Grundsätzen des deutschen Steuerrechts und an abkommensrechtlichen Grundsätzen an. Ziel der vorliegenden Dissertation ist es, die verschiedenen internationalen Regelungen zur Problematik der Gesellschafter-Fremdfinanzierung typisierend zu erfassen und nach den relevanten Grundsätzen zu würdigen. In Anbetracht der restriktiven Rechtsprechung des EuGH wird das Hauptaugenmerk auf europarechtliche Tatbestandsvoraussetzungen gerichtet, jedoch finden auch die Vorgaben des deutschen Steuerrechts sowie des Abkommensrechts Beachtung. Den Abschluss findet die Untersuchung in einer Darstellung und Würdigung verschiedener Reformüberlegungen zur Ausgestaltung der Regelungen zur Gesellschafter-Fremdfinanzierung und der Ausarbeitung eines Lösungsvorschlags, der weitgehend die verschiedenen Ebenen der Kritik anspricht und mit dem Regelungszweck vereint. Dieser Lösungsvorschlag wird abschließend auf den Prüfstein der verschiedenen steuerlichen, europarechtlichen und abkommensrechtlichen Grundsätze gestellt.
