Die Rolle der Evolution in Hayeks Konzept freiheitssichernder Regeln
Zusammenfassung Hayek will individuelle Freiheit durch Regeln geschützt wissen, die neben anderen Anforderungen insbesondere dem Erfordernis der Allgemeinheit genügen müssen. Hayeks Universalitätsprinzip erweist sich jedoch insofern als offen, als es Differenzierungen nach unterschiedlichen individuellen Merkmalen erlaubt, Dabei scheint er jedoch die Angabe von Merkmalen, nach denen derartige Differenzierungen vorgenommen werden können, oder die eines Verfahrens hierzu schuldig zu bleiben. Tatsächlich stellt jedoch die kulturelle Evolution ein derartiges „Verfahren“ dar. Das Ergebnis der kulturellen Evolution sind Verhaltensregeln, die auf allgemein akzeptierten Differenzierungsmerkmalen basieren. Konsequenterweise sind diese Merkmale auch als normative Grundlage der freiheitssichernden Regeln heranzuziehen. Damit kommt der kulturellen Evolution eine maßgebliche Bedeutung bei der Gestaltung der freiheitssichernden Regeln zu.
