Diseños institucionales de control de concentraciones : análisis y propuesta
This paper describes and analyzes the laws governing merger control in Chile. It deals mainly with the procedural issues that arise in coherently enforcing a competition policy that is consistent with the objective sought by antitrust law. Taking into account economic and legal literature as well as comparative regulatory experience, it also proposes recommendations to move towards a more effective and transparent institutional design for a merger control regime. The paper concludes that a mechanism like the one being proposed should be adopted in an amendment to the law that sets the essential framework, leaving the more specific aspects of enforcement of that amendment to the regulatory authorities.
