Economic Development and the Judiciary
In this study, I seek evaluate which features of a judiciary impact economic development. Specifically, I examine the relative effects of judicial review and judicial independence. Previous studies of the judiciary's effect have found that judicial independence significantly impacts economic growth (e.g. Feld and Voight 2004); however, oftentimes these studies bundle together measures of judicial independence and judicial review into a single measure. I argue that judicial independence and judicial review are conceptually distinct and have differential effects on growth. In particular, I hypothesize that while judicial independence (the judiciary's ability to make decisions absence of extra-legal influences) should positively impact economic development, judicial review (the judiciary's ability to declare acts of government unconstitutional) should have no impact unless constitutionally enumerated property rights exist. This study provides important insight into the nature of the relationship between the judiciary and economic development as well as makes an important conceptual argument
