eSIM: Potentiale, Anforderungen und Wettbewerbsprobleme
Der Einsatz von eSIM in Endgeräten, die auf mobile Kommunikation zurückgreifen, nimmt sowohl im Consumer- als auch im M2M-Bereich stetig zu. Die vorliegende Studie untersucht mögliche Auswirkungen der eSIM auf den Wettbewerb mit einem Fokus auf Anwendungen im Consumer-Bereich. Dabei konzentrieren wir uns auf die Anwendungsfelder "mobile Kommunikationsdienste über Smartphones", "Smartwatches mit eingebauter eSIM" und "vernetztes Automobil". Am Markt bereits zu beobachtende und mögliche zukünftige Wettbewerbsprobleme werden diskutiert. Auf dieser Grundlage wird analysiert, ob im bestehenden rechtlichen Rahmen auf europäischer und nationaler Ebene Lösungsansätze vorhanden sind, die geeignet erscheinen, um diese Wettbewerbsprobleme zu adressieren. Am aktuellen Rand sehen wir in den drei Anwendungsfällen nur wenige Hinweise auf Wettbewerbsprobleme von Marktteilnehmern. Auch von Seiten der Konsumenten liegen wenig Beschwerden vor. Es bleibt abzuwarten, ob dies daran liegt, dass die eSIM (noch) wenig Marktrelevanz besitzt. Schwierigkeiten treten vor allem im Zusammenhang mit der Kompatibilität zwischen Diensten kleinerer MVNOs und der Software bzw. den Betriebssystemen auf Endgeräten auf. Perspektivisch könnten weitere Probleme im Zusammenhang mit den implementierten Standards, der Nutzung von eSIM-Locks zu Beschränkungen beim Anbieterwechsel und der parallelen Nutzung von Anbieterprofilen sowie durch eine steigende Relevanz von App Stores bei der eSIM Provisionierung entstehen. Einschränkungen beim Anbieter- und Profilwechsel kann grundsätzlich mit den §§ 59 und 66 TKG begegnet werden. Diese Regelungen zum Kundenschutz adressieren aller-dings nicht die Endgeräte- und Betriebssystemhersteller von Smartphones und Smart-watches, sondern nur die Telekommunikationsanbieter. Hier könnte ein möglicher Lösungsansatz die Einbeziehung der Endgerätehersteller in den § 59 (8) TKG sein, der die Einrichtung von Anbieterprofilen bei einem Anbieterwechsel über die Luftschnittstelle adressiert. Bei Wettbewerbsproblemen im Zusammenhang mit den Smartphone/Smartwatch Betriebssystemen und Plattformregelungen (bei Nutzung der App Stores im Rahmen der Provisionierung) muss geprüft werden, ob die Gebote und Verbote des DMA oder möglicherweise §19a GWB greifen.
