Freedom of Information and Access to File in Competition Law : Evaluations in Light of the General Court's 2014 Mastercard Decision (Rekabet Hukukunda Bilgi Edinme Hakkı ve Dosyaya Erişim: Avrupa Genel Mahkemesi’nin 2014 Mastercard Kararı Işığında Değerlendirmeler)

English Abstract: With its MasterCard decision on 9 September 2014, the Third Chamber of the General Court has emphasized that the essence of public access to administrative documents is traced at the application of exceptions and the procedure of refusal of such request. According to the General Court, the administration has to provide widest access possible to the administrative documents. The administration not only has to interpret and apply the exceptions strictly, but also has to provide reasons in case of refusal.This article explores the Turkish legislation and practice on the right of access to administrative documents by drawing upon the European Union practice and the national practices in Canada, France, Germany, Japan, United Kingdom and United States of America. It is argued that although the legislation in Turkey concerning the right of public access to administrative documents is compatible with its counterparts in other legal systems, there is still room for improvement in practice, particularly in terms of reasoned decisions.Turkish Abstract: Avrupa Genel Mahkemesi'nin Üçüncü Dairesi, 9 Eylül 2014 tarihli MasterCard kararı ile idari belgelere kamunun erişimin özünün, erişim talebinin reddine ilişkin istisnalarda ve usulde aranması gerektiğini vurgulamıştır. Avrupa Genel Mahkemesi'ne göre, temel ilke idari belgelere kamunun en geniş erişiminin sağlanmasıdır. İdarenin yükümlülüğü yalnız söz konusu hakkın istisnalarını dar yorumlamak değil, aynı zamanda talebi reddeden kararını gerekçelendirmektir.Bu makale, idari belgelere erişim hakkına ilişkin Avrupa Birliği'ndeki uygulama, Kanada, Fransa, Almanya, Japonya, İngiltere ve Amerika Birleşik Devletleri'ndeki ulusal uygulamalardan kalkınarak Türkiye'deki mevzuat ve uygulamayı incelemektedir. Kanaatimizce Türkiye'de idari belgelere kamunun erişimi hakkına ilişkin mevzuat, diğer hukuk düzenlerindeki uygulamalarla uyumludur, ancak özellikle gerekçeli kararlar bakımından uygulamada halen gelişmeye açık hususlar bulunmaktadır
