„EU Governance“ und Staateninsolvenz: Optionen jenseits der Kommissionsvorschläge / “EU Governance“ and Insolvency of Governments: Options beyond the Commission Proposals
Zusammenfassung Das am 29. September 2010 von der Europäischen Kommission vorgestellte und dem Europäischen Parlament vorgelegte umfangreiche Maßnahmenpaket stellt die umfassendsten Versuch einer Verstärkung einer europäischen „Economic Governance“ seit Einführung der Wirtschafts- und Währungsunion dar. Angesichts der Mängel der existierenden Gesetzgebung werden dabei eine weiter reichende und verbesserte Überwachung der Fiskalpolitiken, aber auch makroökonomischer Politiken sowie Strukturreformen angestrebt. Neue Durchsetzungsmechanismen für Mitgliedsstaaten, die gegen die Regeln handeln, sind ebenfalls geplant. Im Hinblick auf das sehr wichtige und entscheidende Paket der Kommission, das 6 Gesetzes-Dossiers umfasst, wird in diesem Beitrag versucht, fehlende oder überflüssige und/oder gar nicht verwendbare Elemente zu identifizieren. Weiterhin wird überprüft, was außerhalb und über diese Vorschläge hinaus (überhaupt) noch fehlt, um das gesamte Paket der Governance-Reformen vollständig und durchführbar zu machen. Dies können potenziell Mechanismen zur Krisenlösung und Umschuldung, ein Europäischer Währungsfonds, Projekt-Bonds und/oder Euro-Bonds sein. Der Schwerpunkt der Analyse liegt dabei auf dem Europäischen Währungsfonds, der als Mittel der Wahl bezeichnet wird. Schließlich erweitert der vorliegende Beitrag seinen Fokus auf aktuelle Ereignisse wie die EU-Gipfel bis einschließlich März 2011, die die institutionellen Grundlagen des Europäischen Stabilitätsmechanismus schufen. Es wird ausführlich erörtert, ob die sich abzeichnende Perspektive eines ab 2013 existierenden permanenten Rettungsmechanismus (ESM) in Verbindung mit der vorher installierten Europäischen Finanzstabilitätsfazilität (EFSF) einen Teufelskreis drohender weiter steigender Zinsdifferenzen und steigender Schulden in der Eurozone auslösen kann. Zu diesem Zweck wird aus ordnungspolitischer Perspektive skizziert, wie eine langfristige Strategie gegen Überschuldungskrisen im Euroraum aussehen sollte. Darauf aufbauend werden Gründe für anhaltende Marktspannungen in der Eurozone herausgearbeitet und institutionelle Mängel der gefundenen institutionellen Lösung zum Umgang mit der Illiquidität und der Insolvenz von Eurostaaten abgeleitet. Der Beitrag endet mit einem Ausblick und liefert eine Einschätzung darüber, ob die Eurozone ihre Schuldenkrise in den kommenden Jahren in den Griff bekommen wird.
