Das vorliegende Buch ist das Ergebnis langjähriger Forschungen des emeritierten Innsbrucker Ordinarius für Bürgerliches Recht und Grundlagen des Rechts Heinz Barta, der eine minitiös belegte These erläutert, die bereits aus dem Buchtitel resultiert und der er als im geltenden Recht und auch inzwischen in der Rechtsgeschichte ausgewiesener Grundlagenforscher nachspürt. Es ist ein interdisziplinäres Werk par excellence, weil es die Brücken zu vielen Fächern schlägt, die sich mit der frühen Antike beschäftigen, und auf ein fast gleichnamiges Werk von Hans Erich Troje von 1971 rekurriert.
