I rimedi di diritto privato nella normativa di derivazione comunitaria
L’applicazione del principio di effettività combinato con il principio di sussidiarietà e con il principio della prioritaria competenza del legislatore nazionale e del preventivo ricorso ai rimedi previsti dal sistema processuale nazionale rispetto alla competenza del legislatore comunitario e alla operatività dei rimedi previsti in ambito comunitario per la violazione di normative comunitarie, modella la disciplina dei rimedi previsti dall’ordinamento interno: si tratta sia di rimedi concernenti la violazione di normativa comunitaria, sui quali si è raccolta vasta letteratura, sia di rimedi concernenti i rapporti di diritto privato disciplinati dall’ordinamento comunitario nelle materie di propria competenza. In queste pagine mi occuperò di questo secondo aspetto. Comunque, in ciascuno dei due settori la disciplina dei rimedi e la loro applicazione da parte del giudice è affidata al diritto interno, sempre che esso provveda a tutelare gli interessi protetti in modo adeguato; altrimenti sovviene l’ordinamento comunitario. In questo senso il ricorso ai rimedi comunitari è solo residuale.
