Informationelle Selbstbestimmung aus ordnungsökonomischer Sicht
[Einleitung] Digitale Daten gelten als das „neue Öl des 21. Jahrhunderts“. Doch während die Ölmärkte etablierten, wenn auch nicht perfekten Regeln folgen, sind die Regeln auf den Informationsmärkten noch im Entstehen. Weder national noch international ist durch legislative Maßnahmen oder die Rechtsprechung ausreichend geklärt, wie die Eigentums- und Verfügungsrechte an personenbezogenen Daten zuzuordnen sind, d.h. wie und von wem private Informationen nutzbar gemacht werden dürfen und wem die Erträge aus der Nutzung der Informationen zustehen. Aus ökonomischer Sicht ist ein Zustand ungeklärter Verfügungsrechte nahezu immer ineffizient, d.h., dass die Allokation auf den Märkten nicht zu einem Wohlfahrtsmaximum für die Gesellschaft führt. Das vorliegende Kapitel widmet sich aus einer ordnungsökonomischen Perspektive der Frage, warum Informationsmärkte für private Daten unter den aktuell bestehenden Rahmenbedingungen nicht effizient funktionieren und welcher Regelsetzungen es bedarf, um diesen suboptimalen Zustand zu über-winden. Dabei soll der Fokus auf personenbezogenen Informationen liegen, die in Form von Daten bei der privaten Nutzung von (Online-)Märkten generiert werden, so dass ein direkter Bezug zum Recht auf informationelle Selbstbestimmung im Internet hergestellt werden kann.
