Internationaler Forderungshandel vor dem Hintergrund der Verschuldungskrise
Eine globale Lösung der internationalen Verschuldungskrise ist derzeit nicht in Sicht. Die Bemühungen aller Akteure - Geschäftsbanken, Schuldner- und Gläubigerstaaten und internationale Organisationen - sind daraufgerichtet, durch eine Vielzahl von Einzelmaßnahmen die Krise zu entschärfen. Ein wichtiges Instrument der Gläubigerbanken zur Begrenzung der bestehenden Risiken ist die Umstrukturierung ihres Forderungsbestandes durch den Handel von Kreditforderungen gegen Umschuldungsländer. Dieser Aufsatz stellt die institutionellen Rahmenbedingungen, insbesondere die rechtlichen Gestaltungsmöglichkeiten des Forderungshandels auf der Grundlage des New Yorker Rechts dar. Rechtsvergleichend wird zudem das englische und deutsche Recht betrachtet. Abschließend wird eine Analyse der Wirkung dieser institutionellen Voraussetzungen des Forderungshandels vorgenommen.
