Läuft die Besteuerung von Wertzuwächsen auf eine Doppelbelastung hinaus? Der Aufsatz setzt sich mit der im 6. Jahrgang (1973) S. 255 £. dieser Zeitschrift von Haller vorgetragenen T'hese auseinander, die Besteuerung von Wertzuwächsen (capital gains) - von realisierten wie von unrealisierten - führe zu einer unter dem Gesichtspunkt der Besteuerung nach der "Leistungsfähigkeit" nicht gerechtfertigten Doppelbelastung. Haller stützt seine gegen die Besteuerung von Wertzuwachserfolgen gerichteten Ausführungen nicht auf die sehr viel allgemeinere (Hobbes-Mill-Kaldorsche) "These von der Doppelbelastung der Ersparnis durch die Einkommensteuer; er lehnt diese generelle Doppelbelastungsthese sogar ausdrücklich ab. Der vorliegende Aufsatz zerlegt die Ausführungen Aallers ın einzelne Argumente und setzt sich mit diesen detailliert auseinander. Es werden insbesondere vier solcher Argumente unterschieden: (1) Wertsteigerungen seien kein wirkliches, weil kein "disponibles*" Einkommen (Illiquiditätsargument). (2) Wertsteigerungen seien volkswirtschaftlich nicht realisierbar; auch eine Kreditaufnahme zur Realisierung von Wertzuwächsen liefe lediglich auf eine inflationär wirkende "Scheinrealisierung" hinaus (makroökonomisches Argument). (3) Bei realisierten Wertsteigerungen sei eine Besteuerung zumindest dann nicht angebracht, wenn es sich lediglich um eine Umdisposition des Vermögens handele. Eine echte - steuerpflichtige - Realisierung läge nur vor, wenn der Wertsteigerungsgewinn dem Konsum zugeführt würde (Argument von der Bedeutsamkeit der Verwendung realisierter Wertsteigerungen). (4) Die Wertsteigerung von unbebauten Grundstücken müßte besteuert werden, weil aus diesen Grundstücken keine anderen Erträge als eben Wertsteigerungen fließen (Argument vom Sondercharakter rein spekulativer Vermögensanlage). Jedes dieser Argumente wird im vorliegenden Aufsatz als unhaltbar abgelehnt. Der Verfasser kommt aufgrund dieser Erwägungen zu dem Ergebnis, daß zwischen Wertsteigerungserfolgen und sonstigem Einkommen unter verteilungspolitischen Gesichtspunkten zumindest keine fundamentalen Verschiedenheiten bestehen, so daß eine Besteuerung sowohl der realisierten als auch der nicht realisierten Wertzuwächse - von den dabei entstehenden technischen Schwierigkeiten abgesehen - gerechtfertigt und wünschenswert erscheint. Allerdings gibt es Fälle - z.B. den des Eigentums an Wohnungen und an Einfamilienhäusern - in denen der durch eine Besteuerung von Wertsteigerungen entstehende Realisierungsdruck aus anderen als "Leistungsfähigkeits"-Gesichtspunkten als "unzumutbar" angesehen werden kann und durch entsprechende Ausnahmevorschriften verhindert werden sollte.
