L'autorità per le garanzie nelle comunicazioni nel sistema istituzionale
<i> L’autorità per le garanzie nelle comunicazioni nel sistema istituzionale </i> (di Lorenzo Cuocolo) - ABSTRACT: L’Autorità per le Garanzie nelle Comunicazioni è un organo di recente istituzione che suscita grande interesse, per la sua difficile collocazione nel sistema istituzionale italiano ed europeo. Il primo punto di interesse è la stessa composizione dell’Autorità (Presidente + Commissari), rimessa alle volontà incrociate di Governo e Parlamento, con la necessaria ricerca di equilibri tra maggioranza e opposizione. Secondo punto di interesse è il settore regolato dall’Autorità: per comunicazione, infatti, bisogna ormai intendere sia la telefonia e le altre forme di comunicazione interindividuale, sia la stampa e le forme di manifestazione del pensiero, rivolte ad un numero indefinito di destinatari. L’Autorità regolamenta dunque i settori compresi negli artt. 15 e 21 Cost., per la prima volta unificati nel comune concetto di "comunicazione". Terzo punto di interesse sono le funzioni esercitate dall’Autorità in relazione alla tradizionale tripartizione dei poteri: e tutto ciò da due differenti punti di vista. Da un lato, infatti, l’Autorità si pone nel sistema istituzionale come elemento di rottura della tradizionale tripartizione tra Parlamento, Governo e Magistratura. D’altro lato, paradossalmente, la stessa Autorità sembra in conflitto col principio della separazione dei poteri, assommando in sé funzioni normative, amministrative e paragiurisdizionali. Quarto punto di interesse si può ritrovare, quale conseguenza del precedente, nel fatto che l’Autorità si riveli spia della crisi della forma di governo parlamentare disegnata dalla Costituzione. E questo, anche e soprattutto in riferimento all’analisi della crisi del sistema delle fonti-atto. Quinto punto di interesse è senz’altro la posizione dell’Autorità in relazione al processo di unificazione europea. L’A.G.C. sembra infatti essere un’importante testa di ponte, un frammento del costituzionalismo
