La legalidad como principio de legitimidad. La legitimidad del estado contemporáneo en la perspectiva de Max Weber: una introducción
El artículo parte de la afirmación de Weber de que el «tipo de dominación legal» es el propio de la modernidad. En primer término, tras analizar los fundamentos de validez del obrar social, las formas de racionalidad y las dos máximas éticas capitales, se determina que la Verantwortungsethik del político correspondería a una racionalidad instrumental a la que le es esencial la «santificación de los medios por el fin». Luego, analizando la concepción weberiana de la burocracia, se concluye que la legalidad no es el único fundamento de legitimidad del Estado contemporáneo; y que la pura legalidad –máxime bajo la forma burocrática– no es ni podría constituir el factor político decisivo de la forma de dominación del Estado contemporáneo, ni de forma de dominación alguna, ya que la esencia de lo burocrático excluye las notas específicas de la política.
