Legal Protection for Artists Whose Digital Works Are Issued Without Permission In The Form of Non-Fungible Token (NFT) (Juridical Review on Law of The Republic of Indonesia Number 28 of 2014 on Copyrights)

Law Number 28 of 2014 on Copyright does not regulate Non-Fungible Tokens as a proof of ownership. The problem that will be discussed is whether the issuance of Non-Fungible Tokens without permission is a copyright infringement and what is the available legal protections for the creator. This paper uses the normative juridical method, which shows the issuance of Non-Fungible Tokens without permission is indeed a copyright infringement either moral rights or economic rights. However, the legal protection of Law Number 28 of 2014 on Copyrights is inadequate so that it relies more on protection from the terms and conditions of the Non-Fungible Tokens marketplace
