Legitimacy vs. Autonomy of Law

Legitimacy is the source of validity and reliability of law and authority. In terms of concept legality and legitimacy are different. If we look at jurisprudence, legitimacy of law is established from law of nature, sovereign authority, customs, social interest, revolution, judicial decision, and political domination, domination of social values and practicality of freedom. Legitimacy is established from rule of law, good governance, and sovereignty. Thus it is judged from substantial and procedural justice and fairness. Ultimately humanity and justice are the base of legitimacy. Sometimes legitimacy can be inconsistent with autonomy of law. Autonomy of law establishes supremacy of legal provision whatever the consequences is established. Autonomy of law is found in British positive school. Furthermore, functional autonomy is adapted in sociological school and institutional autonomy is accepted in realist school. In rest of the philosophy, we cannot find autonomy of law. Practically, absolute level of autonomy is found nowhere. Every discipline is either interdisciplinary or multi disciplinary. If we accept autonomy of law in absolute terms, it may or may not include legitimacy of law. Legitimacy of law is established from process, content and validity
