Müssen die nationalen Krankenversicherungssysteme in der EU harmonisiert werden?
Zusammenfassung Zur Beurteilung der Notwendigkeit einer Harmonisierung der staatlichen Krankenversicherungssysteme der EU-Mitgliedsländer können verschiedene theoretische Ansätze herangezogen werden. Jedoch erweisen sich sowohl der integrationstheoretische Ansatz als auch das Konzept der Bereitstellungskosten sowie der Institutional Comeptition-Ansatz hinsichtlich ihrer Aussagekraft als sehr begrenzt. Ausgehend vom normativen Individualismus werden die Kriterien Legitimation und Finanzierbarkeit eingeführt. Legitimation kollektiven Handelns ist dabei zu unterstellen, wenn in einer hypothetischen oder auch impliziten vertragstheoretischen Situation Einstimmigkeit zu vermuten ist. Die Finanzierbarkeit ist gegebenen, wenn Akteure, die vorher der Produktion zugestimmt haben, ihren Beitrag nicht zurückziehen können. Anhand dieser Kriterien läßt sich zeigen, daß der Verzicht auf eine Harmonisierung der Krankenversicherungssysteme in der EU die überlegene Handlungsalternative darstellt.
