Pflichten und Haftung der Kreditinstitute bei der Anlageberatung
Abstract Noch vor gut einem Jahrzehnt waren höchstrichterliche Entscheidungen zur Haftung von Kreditinstituten wegen fehlerhafter Anlageberatung eher selten. Gegenstand der Erörterung in Lehre und Rechtsprechung waren damals nicht so sehr die beratende Tätigkeit der Kreditinstitute bei der Vermögensanlage, sondern in erster Linie die Aktivitäten von anderen Beratern und Vermögensverwaltern vor allem beim Vertrieb steuerbegünstigter Vermögensanlagen. Heute hat sich die Situation grundlegend geändert. Für die Rechtsberater der Kreditinstitute gehören Haftungsfragen wegen fehlerhafter Anlageberatung zum täglichen Brot, und es gibt eine fast nicht mehr zu übersehende Reihe von gerichtlichen Entscheidungen zur Anlageberatung durch Kreditinstitute und Finanzinstitute, angeführt von dem vielbeachteten Urteil des Bundesgerichtshofs vom 6. Juli 1993 im Bond-Anleihe-Fall. Dieses Urteil hat mit seinen Ausführungen zu den Problemkreisen „anlegergerechte Beratung“ (know your customer) und „objektgerechte Beratung“ (know your merchandise) nicht nur die gewiß verdiente Beachtung gefunden, sondern in der Praxis wegen der daraus möglicherweise zu ziehenden Konsequenzen auch eine breite Diskussion ausgelöst
