Practical Issues and a Need to Harmonize the Law on Public Procurement with the European Union Law
The issue of regulating public procurement comes as an integral part of the transition process that Serbia is trying to bring to a conclusion, and that should result in introduction of transparency and an increase in the level of competition in this type of procurement. Although Serbian legislation is already to a great extent harmonized with that of the European Union, there remain a number of institutes that are regulated in a manner that could result in jeopardizing legitimate interests of both contracting authorities and economic operators.These issues are analyzed in view of the EU legislation on which the Serbian legislation was predominantly modeled and possible solutions to such issues, based on domestic legislation are proposed. Moreover, an account of the new institutes introduced by the latest EU Directive adopted after the Serbian Public Procurement Act has entered into force has been given, and with which the Serbian legislation will have to be harmonized
