O fenômeno da judicialização das políticas de saúde e os outros meios de solução de conflitos, junto ao SUS e aos planos privados de saúde, são examinados neste texto sob o prisma do princípio da isonomia. Indica que o sistema jurídico brasileiro de ações coletivas é insuficiente e busca soluções que se aproximem de uma proteção judicial efetiva do direito à saúde, de uma igualdade de tratamento por parte do SUS, das agências reguladoras e das operadoras de planos de saúde em favor dos usuários dos seus serviços, sejam ou não demandantes judiciais, e, por último, de uma diminuição do número de processos judiciais repetitivos sobre a matéria em questão. This text examines the phenomenon of increased judicial intervention in healthcare policies and other means of conflict resolution vis-à-vis the Single Healthcare System [Sistema Único de Saúde/SUS] and its private healthcare plans from the perspective of the principle of equal treatment before the law. It points out that the Brazilian system of class actions is insufficient and looks for solutions that would help bring about effective judicial protection of the right to healthcare, equal treatment by the SUS, the regulatory agencies and healthcare plan operators to the benefit of the users of their services, whether judicial claimants or not, and, finally, a reduction in the number of repetitive court cases in the subject area in question
