Quando la contaminazione da Ogm è "tecnicamente inevitabile": riflessioni in vista dell’adozione di "misure di coesistenza" nelle Regioni italiane
L’introduzione, nella disciplina comunitaria sull’etichettatura di alimenti e mangimi GM, di una eccezione per il caso in cui vi sia una presenza di materiale Ogm nell’alimento o nel mangime entro lo 0,9% è all’origine delle regole di coesistenza fra produzioni transgeniche, convenzionali e biologiche. Nel momento in cui le Regioni italiane si apprestano ad introdurre siffatte regole è necessario un chiarimento circa il significato dell’espressione "accidentale o tecnicamente inevitabile" utilizzata dal legislatore comunitario. L’interpretazione di questa espressione riguarda gli operatori e le loro responsabilità e riguarda le istituzioni responsabili di individuare efficaci misure di coesistenza e di effettuare i controlli. Alcuni segnali provenienti dalla giurisprudenza e dalle stesse istituzioni comunitarie inducono a ritenere che il limite dello 0,9% configuri una vera e propria soglia, al pari di quelle utilizzate nella normativa sui contaminanti e in altre normative del settore alimentare. Le conseguenze di questa indicazione si rifletterebbero nella configurazione delle misure di coesistenza che potrebbero legittimamente non avere come obbiettivo l’ottenimento di prodotti davvero <em>"Ogm free"</em>, ma ripropongono inevitabilmente il problema dell’effettività del diritto del consumatore a scegliere un prodotto <em>Ogm free</em> e insieme la possibilità per gli Stati europei di autodeterminare il proprio modello di agricoltura.
