Recent Development in Exchange of Information within the EU for Tax Matters

“In a more globalized world, the need for mutual assistance between sovereign states is increasing”. With this first statement Prof. Dr. Roman Seer starts his analysis of the recent developments in the area of Exchange of Information within the EU in Tax Matters. First, Prof. Dr. Roman Seer builds the legal groundwork on this matter by explaining Art. 26 of the OECD Model Convention and TIEA’s (Tax Information Exchange Agreement). After that, Prof. Dr. Roman Seer illustrates the EU directive on Administrative Cooperation (Directive 2011/16/EU, February 15th 2011) and defines the different types of information. The Exchange of Information naturally has boundaries, which are also mentioned in this article. Finally, the article also deals with the important topic of Intergovernmental Administrative Assistance in Tax Collection and Rubik Agreements and closes with solutions and an outlook in the future, in which a cross-border reporting system based on automatic information exchange is inevitable
