Rechtsform der eingetragenen Genossenschaft: warum früher, warum heute?
Zusammenfassung Die einzige unerlässliche Besonderheit jeder eG ist die Art und Weise der Mitgliederförderung. Sie erfolgt seit 1867 mittels eines gemeinschaftlichen Geschäftsbetriebs, dessen Kunden die Mitglieder zugleich sind. Das genossenschaftliche Unternehmen ist zwingend auf die Mitglieder und deren Förderbelange auszurichten und nach dem Selbstkostenprinzip zu betreiben. Der Vorstand ist verpflichtet, Nichtmitglieder im Förderzweckgeschäftsverkehr ungleich zu behandeln. Kommt eine eG dem dauerhaft nicht nach, gehört sie aufgelöst, ersatzweise steht ihr ein Rechtsformwechsel offen.
