Reform der Arbeitsmarktpolitik: Vom fürsorgende Wohlfahrtsstaat zum kooperativen Sozialstaat
Am 12. Juni 1996 verabschiedete das Bundeskabinett den Entwurf eines Gesetzes zur Reform der Arbeitsförderung (AFRG). Der nun im Parlament zu beratende Text wurde der Öffentlichkeit als grundlegende und zukunftsweisende Reform angekündigt. Der vorliegende Essay prüft, inwieweit die Gesetzesnovellierung ihren eigenen Ansprüchen genügt und ob sie ordnungspolitische Impulse enthält, die den Anforderungen des Strukturwandels gerecht werden. Er analysiert die Reformvorschläge hinsichtlich ihrer Ziele, Instrumente, Organisation und Finanzierung, und er bietet alternative Vorschläge zur Diskussion an. Die Studie kommt zu dem Schluß, daß das AFRG gegenüber dem alten Arbeitsförderungsgesetz (AFG) einige Verbesserungen enthält: Vereinfachung von Regelungen, frühzeitige Eingliederungspläne, Einführung eines Teilarbeitslosengeldes, erweiterte Förderung von Berufsrückkehrerinnen und Ungelernten, Stärkung der Autonomie der Arbeitsämter durch Dezentralisierung, experimentelle und übertragbare Budgets, Elemente laufender Erfolgskontrolle. Zentrale Schwächen des Entwurfs sind der Verzicht auf die Formulierung eines neuen beschäftigungspolitischen Ziels der Arbeitsmarktpolitik, die Verschärfung der Zumutbarkeit ohne Ausgleich durch erweiterte Rechtsansprüche auf Arbeitsförderung, die Vernachlässigung der Schnittstellen zwischen Arbeitsmarktpolitik und anderen beschäftigungsrelevanten Politikbereichen, die Widersprüchlichkeit in den Ansätzen zur Modernisierung der Arbeitsverwaltung und das Auslassen von Schritten zu einer Finanzierungsreform. Im Resümee werden die Konturen eines neuen Paradigmas kooperativer Arbeitsmarktpolitik vorgeschlagen.
