Regulating Greenhouse Gases from the Top Down : Using the Montreal Protocol and Clean Air Act’s Stratospheric Protection to Address Climate Change
The Montreal Protocol is considered the most successful international environmental treaty. Its effectiveness has made it a model for other agreements, but its power goes beyond protecting the stratospheric ozone layer. Much of the implementing legislation appears in Title VI of the Clean Air Act and could be read to authorize EPA to regulate greenhouse gases. However, political risks and practical constraints should guide any attempt to employ this authority
