Secured Transactions in Securitisations : The Asset Backed, Whole Business and Synthetic Structures - A Comparative Study between the UK and Colombia

The objective of this paper is to identify current problems and propose legal and regulatory reforms to Colombia's securitisation framework that would enhance efficiency, mitigate risks and allow the development of innovative types of securitisations. To reach that, an analysis of the securitisation legal structure in the UK and in Colombia is done, focusing in the underlying secured transactions. Five specific reforms are proposed based on the aforementioned objectives
