State Nuisance Law and the Climate Change Challenge to Federalism

Several cities have recently brought nuisance suits against major fossil fuel companies, seeking damages to help pay for the costs of adapting to climate change. This paper identifies significant legal precedent for allowing state nuisance suits over transboundary pollution harms and argues that courts should not find that federal law preempts these claims
