Statutory Compensation in Software Copyright Violations : C. A. 2392/99, Ashraz Data Processing Ltd. V. Transbeton Ltd
The Appellant in the case discussed in this note attempted to challenge the existing statutory compensation framework with the aim of increasing the compensation awarded in software copyright violations. By offering alternative interpretations to the statutory compensation clause, the Appellant tried to bring about a change that has been discussed by legislators and legal academics alike for decades. This note outlines the role case law has played in advancing copyright law and discusses the approach taken by the Supreme Court to this particular challenge, from a critical perspective. While the note suggests ways in which the decision could have made a greater impact, it concludes that the rhetoric of the case was a significant step in the direction of reform
