The Digital Markets Act : Fostering Innovation ‘Made in Europe’?

Based on the examples of the GDPR and EU abuse of dominance cases, the Brussels effect of the DMA is likely to be somewhere in between these two past tools of regulatory intervention in digital markets. This is due to the different geographic scope of the different rules, but will also vary according to the different obligations and prohibitions contained in the Articles 5-7 of the DMA. However, the increasing fragmentation of the internet can be expected to act as a complicating factor for this Brussels effect. All of these elements together imply that the DMA is unlikely to specifically help innovation ‘made in Europe’
