The EU Roaming Regulation Upheld and Reviewed

The European Court of Justice upheld the Roaming Regulation (717 2007), rejecting the challenge by the four largest mobile operators that the legal basis on Article 95 EC (now Article 115 TFEU) was invalid and that it violated the principles of proportionality and subsidiarity. The European Commission’s interim report on the second Roaming Regulation (544 2009) found widespread compliance by operators, but prices at or just under the mandatory ceilings. The EC’s Digital Agenda sets a goal of finding a robust solution for roaming by 2012 and has performance indicators of bringing roaming prices down from their present level to national prices levels by 2015
